1) RESERVATION/ EXCLUSIVITY:
Upon your signature and booking fee payment, Fábio Azanha Photography will reserve the time and date agreed upon, and will not make other reservations for that time and date. The amount paid for this reservation is not transferable to another date, and not refundable in case of clients´ desistance of Fábio Azanha Photography ´s services;
It is understood that Fábio Azanha Photography will act as sole and exclusive wedding photographers of the event. THE CLIENT acknowledges that they are responsible for notifying all of their guests that guest photography is not permitted at any time while the professional photographer/s are in session. No other guest/photographer using professional equipment will be allowed by Fábio Azanha Photography at any time during the event. Otherwise it will result in the immediate departure of the Photographer/s without the responsibility of fulfilling the conditions of this contract and without any refund of payment already paid to that date;
2) PAYMENT:
THE CLIENT agrees that 50% deposit is required at the time of contract assignment (unless otherwise agreed between parties); 25% is to be paid anytime up to the date of the event; and the remaining 25% is required in order to release the password to the online proofs. Payment can be made via bank transfer or in cash.
3) TIMINGS AND COMMUTING:
THE CLIENT will be responsible for managing the time and schedules during the event or will appoint someone to this function. Taking into account the period of travel from one place to another, which must be included within the time contracted by THE CLIENT. Fábio Azanha Photography shall make every effort to be in the places within the time specified, but shall not be liable for delays that are beyond their control mentioned in article 19th.
4) FOOD:
THE CLIENT is responsible to ensure a warm meal for the photographers, which must be provided at the same time as the clients´ meal to avoid any setback. THE CLIENT will allow a period of 15 to 30 minutes for this purpose within the time contracted. Fábio Azanha Photography is not responsible for any delay of the Catering services in the service of Staff;
5) NUMBER OF GUESTS:
In the event of a significant increase of the number of guests present at a wedding, a corresponding (to photographer´s quote brochure) adjustment to a final payment instalment will apply;
6) ENGAGEMENT SESSION:
Due to the commitment to weddings at the weekends, engagement/pre-wedding portrait shoots are arranged Monday to Thursday. The location of this shoot is within the area of Greater Lisbon, Sintra or Setúbal. For any other location a charge may apply;
7)RECOMMENDATIONS:
Fábio Azanha Photography is able to share their experiences in scheduling and ways to conduct the event. They can also be available to provide their list of useful professionals to THE CLIENT, such as: Wedding Planners, Videographers, Florists, etc. Fábio Azanha Photography shall not be liable for THE CLIENT’s choices nor for the faults and performance of the indicated professionals;
8) EVENT GUIDE:
THE CLIENT will be responsible (or have someone assigned to this role) for identifying specific people, objects and scenes that THE CLIENT desires to photograph, or have photograph/s with. Fábio Azanha Photography will not be liable for not photographing wanted persons if there is no designated person(s) to help identify or gather people for the photo (s).
9) COOPERATION:
The parties agree to positive cooperation and communication for the best possible result within the definition of this assignment. Fábio Azanha Photography is not responsible for key individuals’ failure to be present or to cooperate during photography sessions, neither for missed images due to details not revealed to Fábio Azanha Photography in writing. Fábio Azanha Photography is not responsible for delivering work that might be compromised by negative attitudes of THE CLIENT that hinder or impede the proper development of the Photographer/s function. Fábio Azanha Photography recommends that THE CLIENT designates an “event guide” (see paragraph above) to point out important individuals to the photographer, whom THE CLIENT wishes to include in informal or candid photographs.
10) GUEST AND OTHER VENDORS´ COOPERATION:
THE CLIENT is responsible for the conduct of their guests. THE CLIENT will direct all other service providers (florist, DJ, caterer, etc.) to provide any needed information and cooperation to the photographer. Coordination with other service providers is necessary to complete all the photography sessions as scheduled. THE CLIENT should share the photography schedule with other service providers to make sure that there is no conflict in times. In addition, events during the wedding day should be planned to make the best use of time from all vendors.
Fábio Azanha Photography will not tolerate verbally or physically abusive behaviour, nor will they share their time or compete with guest photographers for the attention of the subjects. Unchecked guest conduct that interferes with photography may seriously affect the quality of the photographs taken and increase the number of times photos must be re-taken. If THE CLIENT is unable to control the conduct of their guests, resulting in an unacceptable degree of misconduct, or if the conduct of any of their guests damages the equipment of the photographer(s), it will result in an early or immediate departure of the photographer/s. THE CLIENT understands that in such event, no refunds will be granted and THE CLIENT will be fully liable for all damage caused to equipment, including the cost of repair or (where repair is not reasonably possible) replacement;
11) SHOOTING TIME / ADDITIONS:
The photography schedule and selected methodology are designed to accomplish the goals and wishes of THE CLIENT in a manner enjoyed by all parties involved. THE CLIENT and Fábio Azanha Photography agree that positive cooperation and punctuality are therefore essential. Shooting commences at the scheduled time. Should the ceremony start late due to any reason whatsoever, Fábio Azanha Photography will not be held liable for any photographs not taken and there is no guarantee that extra time will be permitted by Fábio Azanha Photography. A quote of 150€ will apply for each additional hour;
12) HOUSE RULES:
Fábio Azanha Photography is limited by the guidelines of the ceremony official or the reception site management. THE CLIENT agrees to accept the technical results of their imposition on the photographer. Negotiation with the officials for moderation of guidelines is THE CLIENT’S responsibility; Fábio Azanha Photography will offer technical recommendations only;
13) COPYRIGHT: The photographs produced by Fábio Azanha Photography are protected by Copyright Law (all rights reserved) and may not be reproduced in any manner without Fábio Azanha Photography explicit written permission;
After the final payment, the photographs are owned by THE CLIENT only for diverse personal use and for the purpose of reproduction and distribution of photographs among friends and relatives. THE CLIENT must obtain written permission from and compensate Fábio Azanha Photography where the photographs are published or sold for profit purposes;
14) AUTHORIZATION OF IMAGE USE:
THE CLIENT hereby assigns and grants Fábio Azanha Photography the irrevocable and unrestricted right to use and publish photographs of THE CLIENT or in which THE CLIENT may be included both during an “engagement shoot” and the actual “wedding”, for editorial, advertising or any other purpose and in any manner and medium, ie Fábio Azanha Photography webpage, Blog, Instagram, Facebook, Pinterest , or wedding inspiration blogs and magazines, wedding photography association competitions etc.
Fábio Azanha Photography undertakes not to disclose images that THE CLIENT deems to be excessively private, offensive or that may in any way harm his image or that of the guests.
THE CLIENT also agrees that after the wedding date images may be used as a “sneak preview” for marketing purposes on social networking sites such as and not limited to Facebook and Twitter;
Should any Vendor/ Professional involved in the event wish to use any of the images produced by Fábio Azanha Photography, they are required to obtain the permission from THE CLIENT and from Fábio Azanha Photography. Granting other Vendors/ Professionals permission to use the photographers ́ images implies that the Vendor/ Professional agrees to use explicit references of the photographers ́ credits with Social Media links and the photographers ́ website URL link from other Vendors/ Professionals ́ webpage. Fábio Azanha Photography reserves the right to be the first to share images from the event on their Social Media Platforms and/ or Blog and reserves the right to retain any image/s from other Vendor/Professional until these are first shared on Fábio Azanha Photography Blog/Social Media.
15) – DIGITAL ALBUNS: If album (s) is included in the contract, the CUSTOMER will accept that:
I – The photos entering the album will be only those produced by the Fábio Azanha Photography;
II- The album will be produced only by the Fábio Azanha Photography’s album manufacturer;
III- The first layout modification is free of charge. The remaining modifications for the album layout draft will cost 40.00 € for each layout modification;
IV -The album layout will be sent to the manufactured for production only after:
1) THE CLIENT´S explicit approval of the albums final layout
2) THE CLIENT´S full payment of the digital album;
V – Shipping costs are not included in the contract total;
VI -The album layout will be produced according to the Fábio Azanha Photography availability and workflow;
VII -After the approval of the layout and payment, the album will be ready for delivery or pick up within 3 to 4 weeks from the date of the payment;
VIII – It is THE CLIENT´s responsibility to ensure that they view Fábio Azanha Photography album samples. Otherwise THE CLIENT accepts the quality of the product with no rights to exchanges or returns;
IX – Customer understands and accepts that photographs viewed on a Computer Monitor or TV may not be identical to album printing in its hue and contrast;
X – If the Album is not withdrawn within 12 months after its production, it will automatically be incorporated into the Fábio Azanha Photography Sample Albums set, with no right to a refund;
16) -TIME AND DELIVERY FORMAT: The period of completion of deliveries of the online photo proofs is 8 weeks. The online proofs will be available on Fábio Azanha Photography website in JPG format, in low resolution and with Watermark. Fábio Azanha Photography will provide the password for online proofs to THE CLIENT only after receiving the confirmation of payment of the last installment. For Layout and Album Delivery Time: See Article 15.
All images presented to the client are a final selection. Any other images will not have passed photographers´ quality control and therefore will not be processed or released to THE CLIENT;
No photo deleted from the selection will be presented to THE CLIENT; Extra retouching, digital manipulation (photoshop corrections) is available to THE CLIENT at an additional cost; The event will be all photographed in a RAW format and delivered in high resolution on CD or Pendrive in JPG format only;
17) -LIMIT OF LIABILITY:
I- In the unlikely event of severe medical, natural, or other emergencies excluding death, it may be necessary to retain an alternative photographer. Fábio Azanha Photography will make every effort to secure a replacement photographer able and/or willing to provide a similar package as chosen in this contract at the same/similar tariff. If such a situation should occur and a suitable replacement is not found, responsibility and liability is limited to the return of all payments received for the event package.
II- Fábio Azanha Photography takes the utmost care with respect to exposure, transportation and processing of photographs; including using professional grade equipment and professional grade backup equipment. However, in the unlikely event of THE CLIENT’S photographs either on electronic media (memory cards or hard drives) being lost, stolen or destroyed for reasons within or beyond Fábio Azanha Photography control, the latter’s liability is limited to the return of all payments received for the event package
III-Fábio Azanha Photography is responsible for producing at least 2 backups of the image files up till the delivery date of the photos (or album) to THE CLIENT. Fábio Azanha Photography is not liable for storing the files with images for lonter than 12 months from the date of the event. Fábio Azanha Photography is not liable to storing images files after thay have been delivered to THE CLIENT;
IV-Where there is a technical failure of equipment, whether camera equipment or media such as memory cards, hard drives, USB media or any other storage device in use at the time of the photography session Fábio Azanha Photography shall not be held liable for such failure that is out of Fábio Azanha Photography´s control.Reasonable care shall at all times be taken to ensure equipment is maintained, cleaned and in full working order prior to any wedding event taking place;
V- Fábio Azanha Photography is responsible for the backup of the images up till the date of delivery of the photos (or album) to THE CLIENT, and is not responsible for keeping these photos beyond this period;
VI – The limit of liability shall not exceed the contract price stated herein;
18) NON-GUARANTEE:
Fábio Azanha Photography shall be granted creative license and artistic license in relation to the choice of locations and poses used. Fábio Azanha Photography´s judgement on photographic style shall be deemed correct. Due to weather variation, availability and willingness of subjects and variations in locations, Fábio Azanha Photography will do their best to honour requested photographs, but do not guarantee any specific picture, background or group arrangement. Although every possible care will be taken to produce photographs of all important and special events during the wedding, Fábio Azanha Photography cannot place an unconditional guarantee on the above. Fábio Azanha Photography will not be held responsible for any ruined photographs due to guests’ (or any other) flashes; or any other ruined photographs due to any other cause in or outside of Fábio Azanha Photography control;
19) PERFORMANCE:
Fábio Azanha Photography shall not be liable for any failure to perform its obligations under this contract where such failure is a direct or indirect result of any acts of God, flood, fire, warfare, government laws of regulations, electrical failure, strikes by suppliers and/or any other condition beyond its control;
20) SEVERABILITY:
If any provision of this agreement is held to be invalid or unenforceable under the law, the validity of this agreement as a whole shall not be affected, and the other provisions of the agreement shall remain in full force and effect.
21) LAW: This contract shall be governed by the Laws of Portugal and any judicial initiative should be referred to and initiated at the Lisbon Court;
22) SEVERABILITY & LAIBILITY: The named parties on this contract are both jointly and severally liable under this contract. Where this contract is signed electronically and signed by only one party they shall accept by signing this document that they have the authority and approval of the other party and agree it is done so on the absent parties agreement and are therefore both liable under the terms of this contract
